1. Acceptance of Terms
By accessing and using Vircept's AI Voice Assistant service ("Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use our Service. These terms apply to all visitors, users, and others who access or use the Service.
2. Service Description & AI Disclaimer
Vircept provides an AI-powered voice assistant service that handles incoming phone calls, captures leads, and automates customer interactions.
PROHIBITED VERTICALS (NO MEDICAL/LEGAL USE): The Service is NOT HIPAA compliant and is NOT designed for use by legal professionals handling privileged information. You are strictly prohibited from using the Service to process Protected Health Information (PHI) or Attorney-Client Privileged data. Accounts found violating this policy will be terminated immediately.
AI Accuracy Disclaimer: The Service utilizes artificial intelligence technologies, including Large Language Models (LLMs), to generate responses. While we strive for accuracy, AI systems may occasionally generate incorrect, misleading, or “hallucinated” information. Detailed verification of any output is your responsibility. The Service should not be relied upon for critical professional advice.
3. Voice Recording & Legal Compliance
3.1 Call Recording Laws: You acknowledge that the Service processes audio in real-time. While we do not retain raw audio recordings, we do retain text transcripts. You are solely responsible for complying with all applicable laws regarding call recording, monitoring, and transcription in your jurisdiction, including but not limited to “Two-Party Consent” laws in the United States and PIPEDA requirements in Canada.
3.2 Notification of Recording: You agree to utilize the Service's features to properly notify callers that they are being recorded or speaking with an AI, where required by law. Vircept assumes no liability for your failure to provide adequate notice to callers.
3.3 Emergency Services: The Service is an inbound call handling solution and is NOT a replacement for traditional 911 or emergency services. The Service may not support emergency calls to public safety answering points.
4. User Accounts and Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. You represent that any information you provide is accurate and current.
5. Acceptable Use Policy
You agree not to use the Service for any unlawful purpose. Specifically, you are prohibited from:
- Using the Service for harassment, stalking, or spamming (robocalls).
- Impersonating any person or entity or falsely stating your affiliation.
- Interfering with or disrupting the integrity or performance of the Service.
- Attempting to decipher, decompile, disassemble, or reverse engineer the software.
- Recording third parties without their required consent.
6. SMS Text Messaging Terms
6.1 Appointment SMS Notifications: If you schedule an appointment through our AI voice assistant, you may opt in to receive SMS text messages related to your appointment. By providing express verbal consent when asked during the booking call, you agree to receive:
- Appointment confirmation messages
- Appointment reminder messages before your scheduled time
6.2 Consent Mechanism: SMS consent is obtained through our AI voice assistant, which explicitly asks: “Would you like to receive a text message confirmation and reminder for your appointment?” Messages are sent only after you provide an affirmative verbal response (e.g., “yes,” “sure,” “okay”).
6.3 Message Frequency: You will receive a maximum of 2 messages per appointment: one confirmation and one reminder. Messages are transactional and directly related to your scheduled appointment.
6.4 Opt-Out: You can opt out of SMS notifications at any time by replying STOP to any message. This will prevent future SMS notifications for your appointments. You may also contact us at info@vircept.com to opt out.
6.5 Message and Data Rates: Standard message and data rates may apply based on your mobile carrier's plan. We do not charge for SMS messages, but your carrier may.
6.6 Supported Carriers: SMS messages are supported on major US and Canadian carriers. Message delivery is not guaranteed and may be affected by carrier limitations, network issues, or device compatibility.
6.7 No Marketing: SMS messages are strictly transactional and limited to appointment confirmations and reminders. We do not send marketing, promotional, or recurring messages via SMS.
7. Third-Party Integrations (Google Calendar)
7.1 Optional Integration: The Service allows you to optionally connect your Google account to enable automatic synchronization of appointments to your Google Calendar. This feature is entirely voluntary and is not required to use the Service. You may use the Service's built-in calendar without connecting any third-party account.
7.2 Scope of Access: When you connect your Google account, you grant us permission to create, update, and delete calendar events in your Google Calendar on your behalf. We access only the Google Calendar Events scope and your basic profile email. We do not read, modify, or access any pre-existing events in your calendar.
7.3 Authorization: Connection is initiated through Google's standard OAuth 2.0 consent flow. You will be redirected to Google to review and approve the specific permissions requested before any access is granted.
7.4 Credential Storage: OAuth tokens obtained through the authorization flow are encrypted at rest using AES-256-GCM authenticated encryption. We store only the minimum credentials required to perform calendar operations on your behalf.
7.5 Revoking Access: You may disconnect your Google account at any time from the Appointment Settings page in your dashboard. Disconnecting immediately deletes the stored credentials from our database and revokes our access token at Google. You may also revoke access directly from your Google Account permissions page. Upon disconnection, the Service will revert to using the built-in calendar. Events previously synced to your Google Calendar will remain there; we will no longer be able to modify or delete them.
7.6 No Warranty for Third-Party Services: We do not guarantee the availability, accuracy, or reliability of any third-party services, including Google Calendar. The integration is provided “as is.” We are not liable for any issues arising from Google's service outages, API changes, or your Google account settings.
7.7 Google API Compliance: Our use of Google APIs complies with the Google API Services User Data Policy, including the Limited Use requirements.
8. Payment Processing
Payments are processed securely through PCI DSS compliant third-party payment processors. We do not store your full payment card information on our servers. All payment data is encrypted and handled according to industry security standards.
9. Billing and Cancellation
9.1 Subscription Fees: Fees are billed in advance on a monthly or annual basis. You authorize us to charge your payment method for all fees due. Rates are subject to change with reasonable notice.
9.2 Cancellation: You may cancel your subscription at any time via your dashboard. Cancellation will be effective at the end of the current billing cycle.
9.3 Cooling Off Period: In accordance with consumer protection laws, you may cancel your initial subscription within 14 days of purchase for a full refund (“Cooling Off Period”) by contacting support, provided you have not significantly utilized the Service (e.g., exceeded usage limits).
9.4 Refund Policy: After the Cooling Off Period, payments are generally non-refundable. Usage-based charges (e.g., overage minutes) are strictly non-refundable as they represent consumed telecom resources.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIRCEPT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
11. Changes to Terms
We reserve the right to modify these terms at any time. We will provide notice of significant changes by posting the new terms on this site or by sending you an email. Your continued use of the Service after such changes constitutes your acceptance of the new Terms of Service.
12. Governing Law
These Terms shall be governed and construed in accordance with the laws of Israel, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
